The State Water Resources Control Board (State Water Board) adopted emergency regulations that prohibit commercial, industrial, and institutional (CII) property managers from irrigating non-functional turf. Emergency regulations adopted under Water Code section 1058.5 are effective June 10, 2022 for up to one year, unless rescinded earlier, or extended by the State Water Board.
"Non-functional turf" means turf that is solely ornamental and not regularly used for human recreational purposes or for civic or community events. Non-functional turf does not include sports fields and turf that is regularly used for human recreational purposes or for civic or community events.
This application is for homeowner association (HOA), businesses, and commercial properties that are requesting an exemption from the emergency regulation. Customer who are requesting to be exempt from the irrigation ban on non-functional turf will need to justify that the turf is a low water use plant. Please complete all sections of the application and include supporting documentation (if available).
Please provide a brief narrative explaining why the turf on the property should be exempt from the irrigation ban on non-functional turf. This includes a description of the low water use plant with a plant factor of 0.3 or less and demonstrates the actual use is less than 40% of reference evapotranspiration. (C.C.R. § 996)
